7/6/25 Update
My client’s system had NO production since 2/25 and we’re in the process of submitting our complaint to the California AG and our CLAIM to the Sunnova bankruptcy court.
————————————————————————
From my client’s 2014 California contract Exhibit 2:
2 . LIMITED WARRANTIES
(c) Performance Warranties and Guaranty (p.16)
B. (ii) Power Monitor
During the Lease Term, we will provide you at no additional cost our Power Monitor service (“Power Monitor”). If your System is not operating within normal ranges, the Power Monitor will alert us and we will remedy any material issues promptly
As I looked through the monthly production charts I found several outages and apparently Sunnova is NOT monitoring the system as required by this clause.
It is NOT the customer’s obligation to monitor the system under THIS contract.
It makes business sense for Sunnova to IGNORE system production issues as it is much more profitable to pay a few bucks for underproduction than to pay for repairs.
Occasional outages are likely related to bad wires (critter or weather damage) and could cause a fire.
My client first contacted them last fall, scheduling a tech took numerous emails and finally they did “something” so the system produces at most 50% and is often offline entirely.
Sunnova failed to “remedy any material issues promptly.”
We are awaiting roofers to remove tiles for safe access to repair, but nothing has been scheduled.
7/6/25 Update: Sunnova chat advised several weeks ago that they were waiting for materials. Likely because Sunnova stopped paying its suppliers. Clearly, waiting for the “roofers” was a lie.
