In my client’s case, she received only 17 cents per kWh credit for underproduction.  Because she is on a Time of Use (TOU) plan with her utility, it is impossible to calculate her actual damages due to underproduction, but the MINIMUM rate is currently 28 cents per kWh.

Additionally, my client’s contract contains a 10-year Output Warranty that Sunnova failed to honor and refused to explain.

To date, Sunnova failed to answer our questions regarding the clearly forged Amendment and the 10-year Output Warranty in my client’s lease:

1) Please define the terms in this contract clause and provide a sample calculation:

The System’s electrical output during the first ten (10) years of the Lease Term shall not decrease by more than fifteen percent (15%). This output warranty is in addition to the Energy Production Guarantee in Section 2(c)(i) of this Exhibit 2 and you will be provided a refund check for underproduction as set forth in Section
2(c)(i).
