I have been assisting a California defrauded Sunnova customer since 2017 with her countless and seemingly never ending Sunnova problems. I am updating my Sunnova Knowledgebase with the bankruptcy information:

Most Sunnova customers with defective and under-producing solar systems are unable to pay for lawyers to represent them.Pro Se Party in Interest Soto addresses some of the issues in his Motion to Alter or Amend Orders [Dkt. 109 and 124].

I am working on my client’s claim to submit to the bankruptcy court and as I am not an attorney, we will greatly appreciate your guidance.
How should we determine the amount of the claim?
For example, it is often impossible to calculate how much more customers paid to utility companies because of defective or under-producing systems when on a Time of Use plan with various rates at various times:

In my client’s case, Sunnova’s credit is only 17 cents per kWh, while utility rates are much higher and currently range from about 24 to 58 cents per kWh.
Sunnova’s agent Kroll is extremely unhelpful, refusing to provide the DEADLINE for claims on its CLAIMS page:

It should state that the deadline has yet to be set by the court and once the date is available, it should be displayed on the MAIN page and on the Claims page. Sunnova should have to notify ALL customers, present and past, that they can file claims with the court. A sample customer claim should be at the Kroll site along with a customer claims specific FAQ.
Additionally:
- The Kroll chat support is very limited (Monday through Friday, 9:00 a.m. to 6:00 p.m EST).
- Sunnova’s Ch. 11 notice to its customers did NOT mention that they could submit their claims to the court.
I am also working on our complaint about Sunnova’s extensive and systemic FRAUD with your office:
- Apparently Sunnova utilized a falsified electronically signed Amendment with lower production guarantees, and DocuSign actively supported its no doubt very profitable customer Sunnova and refused to investigate my client’s allegedly DocuSigned Amendment.
- Sunnova failed to apply my client’s credit for underproduction to her outstanding balance, it failed to honor our request to stop billing because the system has produced ZERO kWhs since 2/25 and it instead sent the Notice of Default.
- Sunnova engaged in systemic REVIEW FRAUD at various review sites.
- The Houston BBB apparently responded on behalf of Sunnova to achieve a “complaint resolved” false outcome to improve the Sunnova BBB rating.
Am I wasting my time?
ALL Sunnova customer accounts should be audited to ensure that the correct production guarantees were used to calculate credits and that credits were actually applied to customer accounts.
ALL Sunnova contracts should be reviewed to ensure authentic signatures.
Do you have any advice for Sunnova customers with claims?
With federal regulators defunded and fired, we depend on the states, and especially California, to step up and ASSIST the 444,000+ Sunnova customers [Bondoro.com] and PROSECUTE the executives who engaged in this giant fraud.
